Ruling Promotes Jobs and Benefits

Regulators gave a green light to the FDS Coke Plant's modified air permit-to-install (PTI), which opens the way for a $1 billion economic benefit to Ohio. The Toledo project will have an estimated capital investment of more than $600 million and will create up to 1,500 temporary construction jobs and 150 permanent jobs.

The Ohio Environmental Review Appeals Commission (ERAC) upheld the permit on September 29, with a finding that the state-of-the-art non-recovery coke plant did have binding obligations that required a continuing program of installation that would be "completed within a reasonable time."

ERAC's action reaffirmed its prior decision that upheld dismissal of a lawsuit filed against the plant's modified air permit by the Village of Harbor View and the Sierra Club.
